Terms and Conditions (T&C) for Ebike.MT Rental

1. Rental Agreement and Scope of the T&C
By renting an eBike provided by Viral Marketing Ltd under the brand Ebike Malta (“Company”), you (“Renter”) agree to these terms and conditions. These terms apply to the use of rental eBikes provided by Ebike Malta and operating in the Republic of Malta. Any deviations must be agreed upon in writing by the Company.
2. Rental Period and Rates
Rental period starts at pick-up time and ends upon return. Daily rentals must be returned 15 minutes before closing time. Opening hours are 8:30 to 11:30 and 17:00 to 19:00 from April 1st to October 31st, and 16:00 to 18:00 from November 1st to March 31st. Returning after closing time incurs a late return fee of €20 plus the full-day rental rate applicable at the time of booking.
Extensions are allowed subject to authorization from Ebike.MT and availability.
3. Payment, Deposits, and Refunds
A valid ID or passport must be presented when picking up the bike. A valid credit card in the same name of the booking person is required. A security deposit of €100 per eBike is pre-authorized (not charged) at rental time. The pre-authorization is held for at least 7 business days after the return of the bike, pending inspection. If no issues are flagged by our team, the deposit is automatically released to the original card.
Refunds for valid cancellations follow the same schedule and conditions as the deposit release. Once a cancellation is confirmed, the platform processes the refund automatically, typically within at least 7 business days. Timing depends on the payment provider and is beyond the Company’s control.
If payment is not made on time, the Company may charge a late fee and suspend services. Unresolved payments may result in legal action to recover the owed amount.
4. Cancellations, Booking Changes, and Garage Policy
Cancellations or booking changes such as garage location changes are only accepted if requested at least 48 hours before the start of the rental.
- Cancellations made with sufficient notice are eligible for a full refund.
- Cancellations within 48 hours of the start date are non-refundable.
- No-shows are treated as last-minute cancellations and are also non-refundable.
The Renter must pick up and return the bike to the same garage selected during booking. Changes to garage location may be considered only in exceptional cases with:
- A minimum of 48 hours’ notice
- Explicit confirmation from our team
- Subject to availability
Renters are strongly advised to stick to the original garage location to ensure availability and a smooth experience.
5. Use of the eBike and Restrictions
The Renter must be aged 16 or older. Riders under 16 are only permitted if accompanied by a legal guardian as the Renter. If the Renter allows a person under 16 to ride, they declare themselves fully and legally responsible for the safety, conduct, and compliance of the minor. By accepting these Terms and Conditions, the Renter confirms that they take full responsibility for any underage rider under their care.
The Renter must follow all traffic laws and wear a helmet. The bike must be returned clean and undamaged. Charges apply for damages beyond normal wear and tear. Carrying other persons is only allowed with the approved child panniers provided by the Company for a fee.
Mountain biking involves risks, including falls, collisions, and terrain hazards. Electric motors amplify both performance and potential dangers. Extra care is required.
Riding under the influence of alcohol or drugs is strictly prohibited. Misuse, reckless riding, or breach of safety rules may result in immediate rental termination and full liability for resulting damages.
6. Damage and Theft
The Renter is responsible for the bike and all accessories during the rental. Damages will be charged as follows:
- Frame: €800
- Battery: €500
- Motor: €500
- Wheel (each): €100
- Tire (each): €15
- Inner tube (each): €15
- Brake system: €100
- Seat: €50
- Handlebar: €100
- Charger: €50
- Lock: €15
- Phone holder: €15
In case of theft or loss, a flat value of €2000 will be charged.
7. Assumption of Risk and Indemnity
The Renter acknowledges the inherent risks of riding an eBike, including the possibility of injury or death. The Company accepts no liability for injury, loss, or damage. The Renter agrees to indemnify and hold harmless the Company from any claims, including third-party claims, resulting from bike use.
If the Renter has a pre-existing medical condition that may impair their ability to ride or handle emergencies, they are advised not to proceed. If they choose to do so, they accept full personal responsibility.
8. Pre-Rental Checks and Roadside Assistance
All bikes are thoroughly checked before being released. If any fault occurs, the Renter must stop riding and inform the Company immediately.
Roadside assistance is included in your rental. It covers:
- One intervention per rental day between 09:00 and 19:00 (until 18:00 from December 1st to March 30th)
- One free inner tube replacement per Renter during the rental period
In case of an issue or accident, contact our team immediately via WhatsApp. Our staff may meet you at the site with a replacement bike. We aim to reach you within one and a half hours in Gozo. You may also visit our garage during opening hours.
9. Safety Gear and Recommendations
Helmets are provided free of charge and must be worn at all times. Additional safety gear such as gloves and pads is highly recommended. A safety guide is sent with your booking confirmation. Proceeding with the rental confirms your understanding and acceptance of these safety recommendations.
10. Privacy and Confidentiality
The Company processes personal data in accordance with the Data Protection Act (Cap. 440). Your data is stored securely, used only for service purposes, and not shared without consent. Renters may delete their account by contacting us at any time.
11. Force Majeure
The Company is not liable for delays or inability to deliver services due to events beyond its control, including natural disasters, extreme weather, civil unrest, government restrictions, or system failures.
12. Acceptance of Terms
By completing a booking, you confirm that you have read and accepted these Terms and Conditions. Renters must explicitly check a box to agree to these terms before finalizing any payment.
13. Waiver and Release
I understand that bicycling, especially on mountain trails, can be hazardous and may result in injury or death. I agree to hold harmless and indemnify Ebike Malta and its employees from any loss or damage, including injury or property damage, related to the use of this equipment. I release Ebike Malta, its owners and agents from all liability for any damage, injury, or death that may result from the use, maintenance, or condition of this equipment.
