Terms and Conditions (T&C) for Ebike.MT Rental
1. Rental Agreement and Scope of the T&C
By renting an eBike provided by Viral Marketing Ltd under the brand Ebike Malta (“Company”), you (“Renter”) agree to these terms and conditions. These terms apply to the use of rental eBikes provided by Ebike Malta and operating in the Republic of Malta. Any deviations must be agreed upon in writing by the Company.
2. Rental Period and Rates
Rental period starts at pick-up time and ends upon return. Daily rentals must be returned 15 minutes before closing time. Opening hours are 8:30-11:30 and 17:00-19:00 from April 1st till October 31st and 16:00-18:00 from November 1st till March 31st. Returning after closing time incurs a late return fee of €20 plus the normal daily rates as specified on the product page.
Extensions are allowed subject to authorization from Ebike.MT and availability.
3. Payment and Security Deposit
A valid credit card in the same name of the person doing the booking is required. Security deposit is €100 per eBike, charged at rental time. A valid ID or passport must be provided. Additional charges apply for damages exceeding the €100 deposit. If the Renter fails to make a payment on time, the Company may charge a late fee and suspend rental services until payment is received. If the payment remains overdue, the Company reserves the right to take legal action to recover the owed amount.
4. Use of the eBike and Restrictions
Renter must be aged 16 or older unless written consent is provided, taking full responsibility for riders under 16. Renter must follow all traffic laws and wear provided helmets. The eBike must be returned clean and undamaged. Charges apply for damages beyond normal wear and tear. Carrying other persons, including children, is allowed as long as they use the children panniers provided by the Company for a fee. The Renter is encouraged to wear appropriate safety gear and ensure all transported items are securely fastened.
Renter acknowledges that mountain biking, especially on unfamiliar trails, involves inherent risks. Scratches, hits, and falls are common, and Renter should exercise caution, particularly on unfamiliar terrain. The Company provides guidance, but the Renter is ultimately fully responsible for their safety.
5. Damage and Theft
Renter is liable for any damage or theft. Renter agrees to take care of the bicycle and any equipment provided at all times during the hire period and accepts liability for the full cost of any loss or damage to the rented bicycle and/or its components incurred during the rental period. Damage includes but is not limited to destruction of wheels, damage to the frame and suspension components, and drivetrain damage.

6. Assumption of Risk and Indemnity
Renter acknowledges the risks involved in riding an eBike, including injury or death, and assumes all risks. The Company is not liable for any injuries or damages. Renter agrees to indemnify and hold the Company harmless from any claims, damages, or expenses arising from the use of the eBike, including third-party liability. The Renter takes full responsibility for any damages caused by themselves or to third parties during the rental period.
If the Renter has any medical conditions that might impair their ability to ride an eBike or handle emergency situations, they are strongly discouraged from proceeding with the booking. If they choose to proceed, they do so at their own risk and responsibility. The Company disclaims any liability for complications arising from pre-existing medical conditions.
7. Pre-Rental Checks and Procedures for Accidents
Ebike Malta has made all compulsory checks to ensure that the bicycle is safe and roadworthy before handing it over to you. Should you become aware of any faults, you should immediately stop and contact us.
In case of an accident involving the Renter and/or third parties or their property, the Renter must notify Ebike Malta immediately. Failure to inform Ebike Malta may result in the Renter being liable for any damages sustained by the Company.
8. Safety Gear and Recommendations
We recommend that all users wear a helmet and other safety gear and seek instruction from Ebike Malta staff in the safe operation of the rented equipment. Helmets are provided free to all participants. Helmets could prevent permanent brain damage in the event of an accident.
A safety instruction list is sent to all Renters alongside the booking confirmation email. This set of recommendations outlines the potential risks associated with riding a mountain eBike, including the possibility of falls, collisions, and injuries. Accepting these terms and conditions and confirming your booking act as a confirmation that you have read and understood them.
9. Privacy and Confidentiality
The Company is authorized to save the Renter’s personal data and use it in compliance with the Data Protection Act (Cap. 440). Renter’s data will be kept confidential and not shared with unauthorized third parties. Should the Renter have reason to believe their data has been misused, they must inform Ebike Malta immediately. Renters may deactivate their account at any time by contacting Ebike Malta. Both parties may terminate the contractual relationship at any time. The Renter can delete their customer account by contacting Ebike Malta. Personal data will be handled according to the privacy policy.
10. Road Assistance and third party liability
Renter is encouraged to have their own liability insurance. Road Assistance Cover is available at €3 per day per eBike, covering up to 2 (two) intervention of our Assistance Team. Damages are excluded for any negligence and/or intentional damage.
11. Further Provisions
These terms and conditions are governed by the laws of the Republic of Malta. Verbal agreements are not valid. The invalidity of any part of these T&C does not affect the validity of the remainder. A valid provision with similar intent will replace any invalid provision.
12. Waiver and Release
I understand that bicycling can be hazardous and can result in injury or death. I also agree to hold harmless and indemnify Ebike Malta, and its employees and agents, from any loss or damage, including personal injury or property damage related to the use of this equipment. I hereby release Ebike Malta, its owners, employees, and rental agents from any and all liability for damage or injury to any persons, including myself, or any property resulting from negligence, installation, maintenance, selection, and adjustment, and use of this equipment. I accept full responsibility for any and all such damage, injury, or death which may result.
